Description


Catholics represent 24% of the US population; the Catholic Church is one of the largest religious bodies in the country. The Church itself as well as Catholic men and women might seek the advice of counsel.  The subject matter of these representations can be significantly related to matters which are regulated by the Church’s own law – canon law.  Awareness of this law will improve the quality of the representation by attorneys.

 

This CLE will not impart the necessary knowledge to allow an attorney to practice canon law. Nevertheless, upon completion, practitioners will have an increased understanding of the relevance of canon law on their clients. This awareness will allow attorneys to answer the following questions:

  1. What is the history of the relationship between the Church and secular governments in the West, and how does this affect legal practice in the US?
  2. What are some of the potential conflicts between my client’s desire to live out his religious faith and the law of the state?
  3. Is a canonical proceeding (an administrative recourse, a contentious process, or an appeal) a faster, more efficient, or more cost-effective means to prosecute my client’s representation? Does a canonical proceeding represent a means of alternative dispute resolution applicable to this particular case?
  4. Are there aspects of my representation which might create problems for my client within the legal framework of his Church?
  5. What is the right corporate or nonprofit structure and organization that should be used for various types of Church entities (dioceses, parishes, hospitals etc.) and what should their governance be?
  6. What are the implications of Church structure on particular financial transactions and what global enterprise liability challenges might this pose?
  7. Would my client’s best interest be prosecuted by associating myself with, or referring this matter to, a canon lawyer?
